Thursday January 13, 2005 at 7:00 p.m., the regular Middlebury Township Board meeting held at the Ovid Municipal Building was called to order by supervisor Anthony Sinicropi with the pledge to the flag. Prayer was given by clerk Audrey Sovis. Sinicropi, Sovis, treasurer Carolyn Stevens, trustees Paul Dutton and Charles Simpson were present. Also in attendance were Planning Commission members Mike Stevens, Rich Givens, Dennis Smalec and Steve Semans. There were17 visitors present. Gary Palmer from Shiawassee County Zoning covered the re-zoning process necessary for the Owosso Speedway to be zoned from A-2 to B-2. Lengthy discussion took place between Speedway owner Dave Bigos, concerned residents and the board. No decisions were made. Jim Capitan reported that the County Board of Commissioners will meet January 27 and will vote on the annexation request of Avery Squires. He added that the other commissioners have a copy of the letter sent to him from Middlebury which clearly states the boardís dissapproval of the annexation. Richard Semans requested permission to transfer 2 burial plots. A motion was made by Dutton, seconded by Simpson to allow that 2 burial plots belonging to Mr. Semans, be transferred to the Eldridge family. All ayes, no nays, carried. A motion was made by Dutton, seconded by Simpson to approve the agenda. All ayes, no nays, carried. A motion was made by Dutton, seconded by Simpson to approve the minutes of the December 9, 2004 board meeting. All ayes, no nays, carried. A motion was made by Sovis, seconded by Dutton to amend the budget, transferring $350.00 from (445) Drains to (451) Highways/Roads with the remaining balance in (445) Drains @ $2,303.41 Sinicropi aye, Dutton aye, Simpson aye, Sovis aye, Stevens aye, no nays, none absent, carried. A motion was made by Dutton, seconded by Simpson to pay the January bills in the amount of $31,039.25 (ck #ís 1357-1374). All ayes, no nays, carried. Three violation notices were read concerning properties owned by Timothy J. Covert, Kenneth Berger and Larry J. Richards. Sinicropi reported that he is waiting to hear from the State in regard to the Metz property. Sinicropi made a motion to have attorney Mark Cooley formally propose to the Village of Ovid, the Inter-local agreement concerning sewer and water hook-up with the additional language inserted that the village requested. Seconded by Dutton. Roll call vote: Dutton aye, Simpson aye, Stevens aye, Sovis aye, Sinicropi aye. No nays, none absent, carried. Resolution 2005-1 A motion was made by Dutton, seconded by Simpson that the board give authority to the supervisor to act as an authorized agent to sign off on County-approved land splits and in the supervisorís absence, the clerk shall be given this authority. Roll call vote: Simpson aye, Sinicropi aye, Dutton aye, Stevens aye, Sovis aye, no nays, none absent, carried. A motion was made by Sovis, seconded by Sinicropi that the board send the supervisor, deputy supervisor and 2 trustees to the Capitol Conference in Lansing on March 2, 2005, at a total cost of $300. All ayes, no nays, carried. A motion was made by Sinicropi, seconded by Simpson to appoint board member Sovis to the Planning Commission. All ayes, no nays, Sovis did not vote, carried. Resolution 2005-2 A motion was made by Sovis, seconded by Dutton to approve the 2005 meeting dates as presented. Roll call vote: Stevens aye, Sovis aye, Sinicropi aye, Dutton aye, Simpson aye, no nays, none absent, carried. A motion was made by Sinicropi, seconded by Sovis to send the supervisor, deputy supervisor, and 2 others to the training seminar for Board of review, held February 15 at Frankenmuth at a total cost of $220. All ayes, no nays, carried. At 9:50 p.m. a motion was made by Sovis, seconded by Stevens to adjourn. All ayes, no nays, carried.
