2005-06 Regular Board Minutes
Thursday June 9, 2005 at 7:00 p.m., the regular Middlebury Township Board meeting held at the
Ovid Municipal Building was called to order by Supervisor Anthony Sinicropi with the pledge to
the flag. Prayer was given by Trustee Charles Simpson. Sinicropi, Clerk Audrey Sovis, Treasurer
Carolyn Stevens and Trustees Simpson and Paul Dutton were present. There were 9 visitors.
A motion was made by Dutton, seconded by Simpson to approve the agenda. All ayes, no
nays, carried. A motion to approve the minutes of the May 12, 2005 regular board meeting was
made by Dutton, seconded by Stevens. All ayes, no nays, carried.
A motion was made by Sovis, seconded by Sinicropi to approve the treasurer’s report. All ayes, no
nays, carried. A motion was made by Dutton, seconded by Simpson, to pay the May bills in the
amount of $13,864.03 (check #’s 1447-1475, ck 1464 voided). All ayes, no nays, carried.
Communications: A violation notice was read concerning property owned by Jerry Lee Van
Deusen Jr. of 530 N. Meridian Road, Ovid. Sinicropi presented information on two upcoming
seminars from the MTA. A motion was made by Dutton, seconded by Stevens to send up to 4
people from the Planning or Township board to the Zoning seminars July 20 and August 17, 2005.
All ayes, no nays, carried. A motion was made by Sovis, seconded by Sinicropi to send 2 people to
the Parliamentary Procedure seminar July 28, 2005. All ayes, no nays, carried. Sinicropi reported
that he has asked a representative from Charter Communications to come and meet with the board
and any concerned customers from Middlebury at the July 14th board meeting. A notice will be put
in the Weekly to announce this meeting.
New Business: A motion was made by Sovis, seconded by Dutton to approve the following
three road contracts for 2005: 1800 tons of 23A gravel on Wilkinson road from Vincent road to
Carland road at an estimated cost of $6,930, Bituminous paving on Simpson road from Warren
road to .75 miles east at a cost of $57,575 less $45,000 gas tax contribution for a total estimated cost
of $12,575 for this project and Gravel reconstruction on Simpson road from Warren road to .75
miles east at an estimated cost of $47,500 less 2004 contract of $27,500 for a total estimated cost of
$20,000 for this project. Roll call vote: Stevens aye, Simpson aye, Sinicropi aye, Dutton aye, Sovis
aye, no nays, carried.
Comments or recommendations were requested by the County on the draft wording of an
ordinance concerning private road development. A motion was made by Stevens, seconded by
Sinicropi to give authority to the planning commission to make any recommendations on behalf of
the township board. This motion was withdrawn by Stevens and a new motion was made by
Stevens, seconded by Sovis, that a letter be sent to the County stating that questions remain
concerning the interpretation of the draft and to convey the board’s various concerns to the county.
A roll call vote was taken: Stevens aye, Sovis aye, Sinicropi nay, Simpson aye, Dutton nay. Motion
was carried. A motion was made by Simpson, seconded by Dutton to allow up to $250 to be spent
on an external hard drive to retain records from the clerk’s old computer. All ayes, no nays, carried.
A motion was made by Sinicropi, seconded by Simpson to have Gary Fortin replace 3 door knobs
with levers at the town hall and to build a base rail for the entry ramp in order to be in compliance
with with Americans with Disabilities Act. All ayes, no nays, carried. A motion was made by
Sinicropi, seconded by Simpson to have the clerk look into the cost of having a website created for
the township. All aye, no nays, carried.
Reports: Gary Fortin, sexton of Middlebury Township Cemetery reported that a new flag
and light were installed and the pump was repaired before the Memorial Day weekend. Simpson
reported that the OMES is still planning for a new building and that a new ambulance will arrive
this summer. Dutton reported that the Ovid Public Library may vote on a millage reduction June
29, as they prepare their budget. Simpson reported that a new fence on the west side of the Maple
Grove Cemetery has been replaced and that the cost will be shared with the adjoining property
owner. At 9:10 p.m. a motion was made by Simpson, seconded by Dutton to adjourn. All ayes, no
nays, carried.
