First St., Ovid, Mi. The meeting was called to order at 7:00 pm by Supervisor Anthony Sinicropi with a Pledge to the Flag followed by prayer led by Trustee Paul Dutton. Roll call was taken with the follow board members present: Supervisor, Anthony Sinicropi; Clerk, Susan Tomasek-Swan; Treasurer, Carolyn Stevens; Trustees, Erin Dutton and Paul Dutton. The following guests were also present: Brent Jones, SEDP representative; Bill Kline; Rich Givens; Bob Dennison; Doug Krebiehl; Bob Cappiello; Dan Stewart, County Commissioner; and Shawn Dilts, Deputy Clerk. Scheduled Comments: Steve Loomis was not available for comment. Bob Cappiello at 781 Warren Rd. came to discuss the issue that he is having with the property at 725 Warren Rd. He stated that he tried to go through the regular channels of the county and feels that he has had no satisfaction to his problem. He presented photos to the board to show the issue in regards to the property. Supervisor Sinicropi stated that the County Commissioner, Dan Stewart, might be able to help and referred Mr. Cappiello to speak to Mr. Stewart. Treasurer Stevens stated that the present owner was planning on selling the property. Mr. Cappiello asked about Dave Chrenka’s role as a far as enforcing the zoning laws in the county. Treasurer stated that the County was short staffed to follow up on every complaint. Trustee P. Dutton stated that a new person was above Mr. Chrenka and would try to speak to him about Mr. Cappiello situation. Trustee P. Dutton stated that he hopes to have things resolved by the next board meeting. Trustee P. Dutton spoke on radon kits available to the Middlebury Township residents at no charge. He had ten tests available but requested that the kit needed to be used. Brent Jones from the Shiawassee Economic Development Partnership thanked the board for the past support to the organization and would hope that we continue the support. General Business: Trustee E. Dutton made a motion to approve the January Agenda with the motion seconded by Trustee P. Dutton. A roll call vote was taken with the following results: P. Dutton-yes; E. A motion was made by Trustee P. Dutton to approve the Treasurer’s report as presented. The motion was seconded by Treasurer Stevens. A roll call vote was taken with the following results: P. Dutton-yes; E. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. A motion was made by Trustee E. Dutton and seconded by Clerk Tomasek-Swan to approve the payment of township’s bills in the amount of $4,803.86 with checks numbered 2283 to 2297. A roll call vote was taken with the following results: P. Dutton-yes; E. Dutton- yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. Communications: Dan Stewart updated the board on the activities are occurring at the county. He discussed the renewal of the 911 outgoing call system. He addressed the different grants that the county had for programs to help kids that are abused and neglected and teen alcohol abuse prevention. Unfinished Business: Trustee E. Dutton made a motion to accept the proposed plan to build a cell tower on the Gulick’s property. Trustee P. Dutton seconded the motion. A roll call vote was taken with the following results: E. Dutton- yes; P. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. A motion was made by Trustee P. Dutton to approve the reappointment of the Board of Review Members of Bill Riggan, Bill Kline, and Bob Cappiello. The motion was supported by Supervisor Sinicropi. A roll call vote was taken with the following results: E. Dutton-yes; P. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. New Business: A motion was made by Trustee E. Dutton and seconded by Clerk Tomasek-Swan to approve sending Clerk Tomasek-Swan, Supervisor Sinicropi, and Trustee P. Dutton to the February 24th MTA’s class on The Basics of Budgeting at a cost of $89.00 per person and to purchase the accompanying book and CD for $27.00. A roll call vote was taken with the following results: E. Dutton-yes; P. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. A motion was made by Trustee E. Dutton and supported by Treasurer Stevens to pay for half of the amount of Clerk Tomasek-Swan internet service to compensate for township use. A roll call vote was taken with the following results: E. Dutton-yes; P. Dutton-yes; Stevens-yes; Tomasek- Swan-yes; Sinicropi-yes. The motion was carried. www.middleburytownship.org Clerk Tomasek-Swan discussed wanting to try Gnu cash, a free program for keeping the township books. If necessary, the board may have to look into purchasing software to keep the books. The board discussed the road projects slated for 2009. Supervisor Sinicropi stated that he had received some complaints by residents who resided on the gravel roads concerning the dust control. Three different brine contracts were presented to the board. Trustee Dutton stated that he spoke to Mike Constine, a resident and employee board member of the road commission, and Mr. Constine had recommended brine plan number two at a cost of $14,437.00. Clerk Tomasek-Swan made a motion for the township to agree to brine plan number 2 at a cost of $14,437.00. The motion was seconded by Trustee P. Dutton. A roll call vote was taken with the following results: E. Dutton-yes; P. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. Supervisor Sinicropi signed the contract for brine plan number 2. Trustee E. Dutton made a motion to approve the slated road projects for 2009 year as presented by the Shiawassee County Road Commission for a total amount of $87,782.71. Treasurer Stevens seconded the motion. A roll call vote was taken with the following results: E. Dutton-yes; P. Dutton-yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. A motion was made to appropriate $500.00 to the organization of Shiawassee Economic Development Partnership (SEDP) for the 2009 year by Trustee P. Dutton and supported by Trustee E. Dutton. A roll call vote was taken with the following results; E. Dutton-yes; P. Dutton- yes; Stevens-yes; Tomasek-Swan-yes; Sinicropi-yes. The motion was carried. It was noted that the annual SEDP meeting is scheduled on February 10th at 11:30 am. Clerk Tomasek-Swan stated that she will be attending the annual meeting concerning the upcoming school elections. Final Comments: Trustee E. Dutton wonder if any updating could be done to the township hall. Supervisor Sinicropi would consider the possibility when preparing the budget. He continues to state his aggravation about the township not owning the road front property at the hall. A motion was made by Treasurer Stevens to adjourn the meeting.
