Middlebury Township Board Minutes Draft Minutes Middlebury Township Board Regular Meeting Wednesday, October 10, 2012 7pm Middlebury Township Hall 7627 W. M-21 Ovid, Michigan 48866 Minutes Supervisor Anthony Sinicropi called the meeting to order at 7:04 pm Call To Order with a Pledge to the Flag and a prayer led by Richard Semans. Members Present: Supervisor Anthony Sinicropi, Clerk Susan Roll Call Tomasek-Swan, Treasurer Carolyn Stevens, Trustee Erin Dutton and Trustee Paul Dutton. Guest Present: Eleven guests were present. They were: Richard Semans, Gary Kiger, Bob Dennison, Rich Givens, Homer Bennett, Tom Dignan, George Zmitko, Gordon Taylor, Michael Herendeen, Diane and Mike Dowler. Scheduled Comments: Scheduled Comments Tom Dignan, Probate Judge candidate spoke on his visions that he has if he is elected as Judge. One of his goals is to have a website set up. He wants people to know what is occurring in the family court system. Homer Bennett, Drain Commission candidate spoke on his qualifications for the position. Mr. Bennett wants to represent every drain in Shiawassee county. Bob Dennison, running for Middlebury township supervisor, stated his desires and qualification to run for the office. Mr. Dennison wants to try to bring the community back together. Paul Dutton, County Commissioner for district one candidate, spoke on his goals and changes he would like to see at the county level. Michael Herendeen, Middlebury Supervisor candidate, reviewed his qualification for the office of supervisor. He hopes to continue serving the township. Gary Kiger, township trustee candidate, reviewed his concerns with continuing road maintenance, Ovid-Middlebury Emergency Service Authority, cemetery maintenance and foolish spending. He plan on voting his conscious. Rich Given, running for trustee of Middlebury township spoke on his involvement with the township and wants to bring Ovid and Middlebury townships as one community. Mr. Givens wants to speak for the people in the township. Public Comments George Zmitko presented to the board his concerns about a parcel on Carland Road which water runs into the field and flows to the south west corner of the property. Mike Herendeen, deputy supervisor and Supervisor Sinicropi had already talked to the drain commissioner about this issue. The Shiawassee drain commissioner thinks there is not enough room to put a ditch to run the water down to the culvert. Mr. Zmitko thinks it would work. Mr. Zmitko quoted a rough estimate of 2 days of work and a price of about $1,600.00. The culverts would also need to be replaced so that would be additional cost. The township needs to find how much time is left on the gradall and use it on this project and finish it with using next year time. Opened 7:23 pm Closed 7:40pm Dick Semans liked to thank the township for approving the ditch job along Warren Road. Mr. Semans feels it will make a difference. Moved by Tomasek-Swan and seconded by P. Dutton to approve the agenda with the addition of Rails to Trails and insurance check. Minutes Approved 12-Sep-12 AYE: All NO: none CARRIED Moved by Sinicropi and seconded by E. Dutton to approve the banking 's report as presented. Treasurer's Report Approved AYE: All NO: none CARRIED Moved by P. Dutton and seconded by Tomasek-Swan to pay bills in with $12,763.72 checks numbered 3178-3196 in an amount of $14,703.94 and road fund check 1016. Bills Payment Approved AYE: All NO: none CARRIED Communications None General Business Cemetery fence is being repaired by Matt Tribfelner and his son. Mike Constine has offered to take down the dead maple trees but not the stumps on the property owned by the township located at Elm Road. Mr. Constine has offered to take trees down for Maple Grove Cemetery which lies next to the Elm Road property. Bob Dennison stated that Mike is not charging for the tree removal. Aye: All Nay: None Carried SEDP Contract: Sinicropi addressed to the board his favor on the (Shiawassee Economic Development Partnership) SEDP Stevens stated her concerns about the SEDP and would like to table until the next meeting when the new board has been sworn into office. P. Dutton expressed his support for SEDP and favors the $500.00 appropriation. Rich Givens stated his concerns that mirrors Stevens' opinion on the amount of money other townships in Shiawassee County appropriates. Richard Semans spoke favorable of SEDP. E. Dutton made a motion to appropriate $500.00 to SEDP (Shiawassee Economic Development Partnership). P. Dutton seconded the motion. Aye: All Nay None Carried Purchasing a new copier for the township was discussed. Stevens and Tomasek- Swan will go and find different models and prices and report back in November. Stevens made a motion to block out 5 rooms for the MTA Annual conference in January. Sinicropi seconded the motion Aye: All Nay None Carried Rails to Trails: Sinicropi would like to propose to the board an idea to help participate with the fundraising of the Rails to Trails. Sinicropi made a motion to place an ad in the Argus Press and Weekly to state Middlebury Township supports the Rails to Trails and where to donate money for the cause and to add a link on our website. Seconded by P. Dutton. Aye: All Nay None Carried OMESA: Richard Semans stated the disposition with McClelland has begun. The new fire captain's son was badly injured in a car accident therefore Jim Brown' former fire captain has been staying on to help. Elm Rd property purchase agreement: Lynn Bowen, the township's attorney, briefed over the new purchase agreement from Owosso Memorial for the Elm Road property. The old agreement expired in April 2012. There are about seven new contingences to the new agreement. Mr. Bowne does not view any of the contingences as being unreasonable. He review each new item and explained everything in layman terms. Tomasek-Swan made a motion for Supervisor Sinicropi to sign the purchase agreement with Memorial DBA Health Care for the Elm Rd property on behalf of Middlebury Township board. P. Dutton seconded the motion. Aye: All Nay None Carried Final Comments Tomasek Swan made a motion to purchase a flag from Dutton Family Sales for the cemetery to replace the old flag.
