Board Members Present: Supervisor Michael Herendeen, Clerk Susan Tomasek-Swan, Treasurer Carolyn Stevens, Trustee Gary Kiger and Trustee Richard Givens Guests Present: Bob Dennison, Richard Semans, Tony Sinicropi, Matt Tribfelner, Diane and Mike Dowler Scheduled Comments: None Public Comments: Opened at 7:08 pm Closed at 7:09pm None Motion to Approve Agenda: Trustee Givens made a motion to approve the agenda with the addition of meetings to attend approval. Treasurer Stevens seconded the motion. Yes: All Nay: None Carried Motion to Approve Minutes: Trustee Givens made a motion to approve the minutes from March’s Budget and Regular meeting held on March 13, 2013. Treasurer Stevens seconded the motion. Yes: All Nay: None Carried Clerk Tomasek Swan made a motion to continue participation in the recycling program with the Village of Ovid with an appropriation of $600.00. Trustee Givens seconded the motion. Aye All Nay None Carried Trustee Givens made a motion to appropriate a $1,000.00 to Parks and Recreation. Treasurer Stevens seconded the motion. Aye All Nay None Carried Treasurer Stevens made a motion to pay the appropriation of $3,639.10 to Maple Grove Cemetery. Clerk Tomasek-Swan seconded the motion. Aye All Nay None Carried Motion to Approve Bills: Trustee Givens made a motion to approve paying the bills with checks 3308-3331 with void on 3323 and 1 EFT in an amount of $10,608.88. Treasurer Stevens seconded the motion. Yes: All Nay: None Carried Communications: None Business: Supervisor Herendeen started a discussion on salary increase. The township board members and representatives have not had an increase since 2002. Mr. Herendeen stated there is never good time to raise salaries but if pay is not adjusted in a timely manner is makes it difficult to raise the amount when times are good and low pay does not encourage qualified people to run or accept board positions. Supervisor Herendeen proposed the salaried position on the township board be raised from $700.00 to $750.00 per month (yearly raise from $8,400.00 to $9,000.00). He continued to propose the trustee position would be paid $140.00 per month for the first meeting any additional meeting would be $40.00 and general meeting fee to $40.00 from $25.00. The general meeting fee has been at this rate for 20 years. Trustee Givens expressed concerned of a raise for the trustee position from$ 100.00 to $140.00. He suggested $ 125 or $135. Resolution 2013-07 Supervisor Salary: Setting the Supervisor salary at $9,000.00 per year. Offered by Clerk Tomasek-Swan and supported by Trustee Givens. Offered by Supervisor Herendeen and supported by Clerk Tomasek-Swan. Offered by Supervisor Herendeen and supported by Trustee Givens. Roll Call AYE: Trustee Givens, Treasurer Stevens, Trustee Kiger, Clerk Tomasek-Swan, Supervisor Herendeen Nay: None Adopted Resolution 2013-11: Resolution to set per Diem for meetings. Resolution was offered by Supervisor Herendeen and supported by Treasurer Stevens. Roll Call Aye: Trustee Kiger, Clerk Tomasek-Swan, Trustee Givens, Treasurer Stevens, and Supervisor Herendeen Nay: None Adopted Resolution 2013-12 Replaces 2007-03 Setting of General Meeting fee Resolution offered by Supervisor Herendeen and supported by Treasurer Stevens. Roll Call Aye: Trustee Kiger, Clerk Tomasek-Swan, Trustee Givens, Treasurer Stevens, and Supervisor Herendeen Nay: None Adopted Matt Tribfelner first addressed the board regarding the flag and flag pole. The current pole is in disrepair and the flag needs to be replaced. Supervisor Herendeen addressed the issue about the lack of ability to light the flag properly. At this point, the sexton will see what can be done the flag pole to have the flag available for funerals. Mr. Tribfelner reviewed the proposal from the Family Tree Lawn Care to care for the cemetery duties, lawn care of township properties and building maintenance. He proposed purchasing some of the smaller equipment from that belongs to the township with the agreement that he township would have the first opportunity to buy the equipment back Trustee Givens made a motion to agree to this contract with Family Tree and Lawn Service, LLC with a change in the hourly rate for building maintenance to $15.00 and to authorize a board member, Supervisor Herendeen, to sign the contract when Matt Tribfelner presents a copy of his contractor’s license. Motion supported by Treasurer Stevens Roll Call AYE: Kiger, Tomasek-Swan, Givens, Steven, and Herendeen NAY: None Carried Trustees Givens and Kiger reviewed on the road contracts and projects with the board. Trustee Givens thought we should do everything but Warren Road dip which could wait until next year. Trustee Givens made a motion to have Mr. Herendeen the authorization to sign the road contracts as presented in the estimates except the Warren Rd project. Treasurer Stevens seconded the motion. Roll Call Aye Kiger, Stevens, Givens, Swan, Herendeen Nay None Carried The OMESA Quiet Title Judgment, Trustee Givens made a motion to give Mr. Herendeen authorization as a representative for Middlebury Township to execute and Mr. Lynn Bowne authorization to execute the judgment of quiet title and the orders of quiet title that comport with the judgment. Stevens seconded Roll Call Aye: Swan, Kiger, Givens, Stevens, Herendeen.
