Middlebury Township PO Box 622, Ovid, Michigan 48866 Regular Board Meeting Middlebury Township Hall 7627 W M21, Ovid Michigan Wednesday, April 11th, 2017 at 7:00 pm Call to Order: Supervisor Herendeen called the meeting to order at 7:02 pm with pledge allegiance. Board Members Present: Supervisor Michael Herendeen, Clerk Rose Brown, Treasurer Stevens, Trustee Gary Kiger and Trustee Richard Semans (Arrived at 7:35 pm) Guests Present: Eight guests were present. Among the guests were Arlene Pesik, Carl Chalker, Karl Heckman, Bob Dennison, Sue Kadlek, Diane & Mike Dowler. James Coon, and Corky McCreery Scheduled Comments: a. James Coon and Sue Kadlek- They asked the township board to donate to the local youth baseball organization. The board presently contributes to the park and recreation board. The Park and Recreation board decides on how the money is spent. Supervisor Herendeen stated the township board is not able to donate to a charity but we could contract for goods and services. Supervisor Herendeen thanked them for coming and presenting. Sue Kadlek presented the budget of the organization of $28,500 but the expenses is $29,000. They have 256 kids with 12% from Middlebury township. The board asked about what the park and recreation plan to allocate to the youth baseball. It was explained that they (O-E Youth Baseball League) plan on attending the Park and Rec meeting and presenting a list of equipment to see what they could fund. b. Mike Bruff- He attended the meeting at the OE high school regarding the wind turbine. There seems to be still some issues regarding the flicker of light and sound decibels. There will another meeting on May 8th at the Owosso High School. The moratorium will end in June. Mr. Bruff speculates that there may be an extension to the moratorium. But he cautioned, the county cannot say no to having the wind turbines. The county needs to have an ordinance in place to control their use. The board asked about the race track. Some of the recommendations have been agreed upon and have been sent to the court. Supervisor Herendeen clarified some of the timeline of the racetrack. He explained how the use for the area has changed and the racetrack was already in existence but now they have a consent agreement. The new owners can inherit the consent agreement but new owners can argue the consent agreement. c. Herendeen expressed his condolences to board member Trustee Kiger regarding the loss of his brother. d. Deputy Clerk Swan expressed sympathy regarding the loss of former Middlebury Township Clerk, Cindy Dennison. Public Comments: Opened at 7:30 pm Closed at 7:50 pm Trustee Richard Semans arrived at 7:35pm Bob Dennison asked about Corky McCreery and others riding with the road commission. The board stated the township has had the ride around with Dick Semans riding with the road commission. Unfortunately, the truck could only hold so many people. Supervisor Herendeen offered Corky McCreery the road project report to look over before the board gets the topic on the agenda. Bob Dennison asked about the drains and if there will be any assessments. Treasurer Stevens explained there are drain assessments because Bob Dennison asked about receiving a letter regard drain assessment. Motion to Approve Agenda: Trustee Semans made a motion to approve the agenda. Clerk Brown seconded the motion. Yes: All Nay: None Carried Motion to Approve Minutes: Treasurer Stevens made a motion to approve the minutes from March 14th 2018 budget and regular meeting as presented. Clerk Brown seconded the motion. Aye: all Nay: None Carried Motion to Pay Bills: Treasurer Stevens made a motion to approve the bills from March 15 to April 11, 2018 totaling $8,277.31 with check # 4812-4829 and 2 EFT. Aye: all Nay: none Carried Communications: Park and Recreations: Ball Bats were discussed. Reviewing the difference between giving to a charity vs a governmental agency. Library: Brief meeting as board member, Eric Brown was paged out and was needed for a quorum. MTA Meeting: Supervisor Herendeen reported the March’s meeting was at Woodhall township. Herendeen is continuing the role of the chairman for Shiawassee MTA. May 1st at 7 pm location at the Burns township hall will be the last Shiawassee MTA meeting before summer break. September will start the MTA meetings again with the locations being at Caledonia township at 7 pm. OMESA: Supervisor Herendeen updated the board on the fire hall. Construction will start in late spring... Assessor: Diane Dowler expressed her gratitude to the Board of Review members. $ 42,871,712.00 is Middlebury taxable value. Clerk Communication: None Business: Clerk Brown reviewed the audit contract. The price will be $6,000.00 plus F-65 which is $750.00.The board needs to approve the contact so that it can be signed and sent. The contract will be through 2020 which will not exceed $6,500.00. Treasurer Stevens made the motion to sign the contract with S,K &T P.C Clerk Brown seconded the motion. Row Call Vote: Aye: Kiger, Semans, Stevens, Brown, and Herendeen Nay: none Carried Road Commission: The board reviewed the proposed road projects. The proposed projects are McBride Road for chip sealing. The gravel roads to be worked on will be Wilkinson, Fenner, and Cronk Rd. This year, the Road Commission will contribute $25,000.00. The final figure is $179,112.50. Trustee Semans made the motion to approval the list of proposed road projects for 2018. Treasurer Stevens seconded the motion. Roll Call Aye: Kiger, Semans, Stevens, Brown, and Herendeen Nay: None Carried Recycling: Supervisor Herendeen stated he received a letter from the city of Ovid regarding recycling. They have reconsidered and lowered the quote to $755.00.The board discussed the recycling and if the residents would benefit from the cost to the township. Trustee Semans made a motion to approve the $755.00 for this year. Supervisor Herendeen seconded the motion. Roll Call Aye: Kiger, Semans, Herendeen Nay: Steven, Brown Carried Treasurer Stevens stated if the City of Ovid discontinued the recycling program that the remaining balance appropriated should be returned to Middlebury Township. Mike Bruff commented that Shiawassee Community Mental Health will recycle for no charge. They have regular 9 to 5 working hours. They will take cardboard and paper. Final Comments: Opened at 8:24 pm Closed at 8:33 pm Trustee Kiger asked about a house on M-21 that has garbage. It was stated that Dave Chrenka needs to be contacted about the garbage issue. Bob Dennison stated there is trailer house that is illegally parked behind a house. Supervisor Herendeen asked for an address. Bob stated people have been living there 2 years. Treasurer Stevens asked about the township building. Trustee Semans stated he hadn’t been working on it.
