Middlebury Township PO Box 622, Ovid, Michigan 48866 Regular Meeting Middlebury Township Hall 7627 W M21, Ovid Michigan Wednesday, October 9, 2019 at 7:00 pm Call to Order: Supervisor Herendeen called the meeting to order at 7:02pm. Trustee Semans lead the board in prayer. Board Members Present: Supervisor Michael Herendeen, Clerk Rose Brown (absent), Treasurer Carolyn Stevens, Trustee Richard Semans and Trustee Gary Kiger Guests Present: Total of five guest in attendance: among them Carl Chalker, Karl Heckman, Mark Holley, Marlene Webster, Deputy Clerk Susan Swan and Don Helvie. Scheduled Comments: 1.) Marlene Webster – Budget time at the county level. Tomorrow night meeting to add members to the road commissioners. New drain commission office will be dedicated that will be known as the Gary W Holzhausen Drain Office and Facilities Building. Public Comments: Opened at 7:05 pm Closed at 7:13 pm Karl Heckman stated that the assessor was out at his property without warning and (Mr. Heckman) didn’t appreciate it. Mr. Heckman wanted to know the reason the assessor was on his property. Supervisor Herendeen explained the assessor duties. Gary Kiger made a comment regarding the assessor going on people’s property as well as Mr. Chrenka, Shiawassee county code enforcer. Mr. Kiger feels that they shouldn’t be able to walk on people’s property. Supervisor Herendeen and Trustee Semans explained the assessor and county code enforcer are licensed to walk on people’s property by state and county regulations. Motion to Approve Agenda: Treasurer Stevens made a motion to approve the agenda as presented .Trustee Semans seconded the motion. Aye: All Nay: None Carried Motion to Approve Minutes: Treasurer Stevens made a motion to approve the minutes from the September 11, 2019 as presented. Supervisor Herendeen seconded the motion. Yes: All Nay: None Carried Motion to approve Bills Supervisor Herendeen made a motion to approve an interfund transfer from the General Fund bank account to the Road fund bank account in an amount of $52,180.84. Trustee Semans seconded the motion. Roll Call: Ayes: Kiger, Semans, Stevens, Herendeen Nays: None Absent: Brown Carried Supervisor Herendeen made the motion to approve the payments of bills in an amount of $6,913.28 from the General Fund with checks 5110-5124 and 2 EFTs. Trustee Semans seconded the motion. Yes: All Nay: None Carried Treasurer Stevens made a motion to pay from the Road Fund $77,749.07 with checks 1057-1061. Trustee Semans seconded the motion. Yes: All Nay: None Carried Communications: Park and Recreation: no meetings OMESA: Short meeting, Repair of generator, Library: and financial and minutes in packet MTA Meeting: Tuesday Nov 5th for annual meeting and it will be at Bennington Township. Woodhall Township was the host for the October meeting. Supervisor Herendeen made a motion to attendees to be the regular meeting fee to the MTA annual meeting. Attendees will pay their own meal fee for attending the meeting. Trustee Semans seconded the motion. Aye: Kiger, Semans, Stevens, Herendeen Nay: None Absent Brown Carried Assessor Communications: Mr. Holley has completed the sample assessment of 30 percent of the property. He also presented the L 4029 for the board approval. Supervisor Herendeen moved to approve the L 4029 with rates as stated. Treasurer Stevens seconded the motion. Roll Call Vote: Aye: Semans, Kiger, Stevens, Herendeen Nays: None Absent: Brown Carried Business 1. Winter Newsletter- Treasurer has completed her portion of the newsletter. The clerk will need to add the election information and dates. Treasurer suggested to mail a separate letter about the road millage from the township. She is concerned because people don’t read the newsletter. The Board discussed the different options. 2. Road Millage – March 10th Ballot – the board discussed the different option to adding the road millage to the ballot. Discussion of how the tax year is collected. The board reviewed the language on the ballot wording. Herendeen will check on the 2020 elections as to when the tax will be collect for the 2020 tax year. Tabled until next month. 3. Sexton – Trash Bin for Cemetery/Hall Use- Deputy Clerk read the text from the clerk regarding the trash and the dumpster at his house. The board will do further investigation. 4. Renewal of Insurance Coverage – Burnham & Flower-The board discussed the different additional add on with the insurance policy. Trustee Semans moved to add Casualty Limited Terrorism, Property Limited Terrorism , Cyber & Privacy Liability and Non Monetary Defense Cost Coverage for a total of $5,159.00. Treasurer Stevens seconded Roll Call Vote: Ayes: Semans, Stevens, Kiger, Herendeen Nays: None Absent: Brown Carried 5. Workers Comp & Employee Liability Insurance Policy- Trustee Semans made a motion to pay $756.00 to Accident Fund for the workman’s compensation insurance. Supervisor Herendeen seconded the motion. Roll Call Vote: Ayes: Kiger, Stevens, Herendeen, Semans Nays: None Absent: Brown Carried 6. Land Swap- Trustee Semans updated the board regarding the property. The owners has made an offer to help the township pay $5,000.00 toward the driveway to help expedite the release of the easement. Final Comments: Opened at 8:32 pm Closed at 8:35 pm Trustee Semans checked on the mowing with the county. November 13, 2019 at 7:00 pm is the next township meeting. Supervisor Herendeen reviewed the other boards meeting dates. Karl Heckman asked about the closed session meeting.
