REGULAR MEETING
Call to Order:
Supervisor Swan called the meeting to order at 7:00 pm.
Board Members Present:
Supervisor-Jeffery Swan, Clerk- Susan Tomasek Swan, Treasurer- Carolyn Stevens, Trustee-Greg Atwood
and Trustee-Gene Ruess-ABSENT
Guests Present: Five Guests were present: Gary Kiger, Mark Holley-Assessor, Mark Darling, Michael
Herendeen and unknown person.

Motion to Approve Agenda:
Treasurer Stevens made a motion to approve agenda as presented. Trustee Atwood seconded the
motion.

Motion to Approve Minutes:
Treasurer Stevens made a motion to approve December 14, 2021 minutes as presented. Clerk Tomasek
Swan seconded the motion.

Motion to approve Bills
Clerk Tomasek Swan made a motion to approve bills from General Funds in the amount of $10,649.76
with checks #5612-5631 6 EFTs. Trustee Atwood seconded the motion.

Communications:
MTA- Next meeting will be February 1, 2022 at Caledonia Township. New Road Commission director,
Chris Cannon. Middlebury Township will be hosting September’s MTA meeting. Veteran’s Affair is
remodeling their offices. Chris Cannon, Road Commission director, spoke about the road commission
buying a new “trailer jetter” to clean out culverts.
Library- Library minutes are attached to board packets. New awning placed in front. Settling in the new
director.
OMESA- The main issue is moving forward with the millage and deciding what to do.
Clerk- MTA annual meeting is coming up in April. Please let the clerk know if anyone is interested in
attending. Please give budget input to the clerk. Clerk Tomasek Swan is hoping to have a workable budget
to present to the board in February.
Assessor- County released numbers January 4th, a month behind the due date of December 1st. June or
July possible for the township’s audit. Assessor Holley is confident the township will be in good standing
for the audit.
Business:
1. Marihuana Ordinance Supervisor Swan updated the board regarding land buying companies
inquiring about the township’s stance on Marihuana ordinance.
2. CD Motion- Treasurer Stevens discussed the township’s CDs (certificate of deposit). Planning on
consolidating all the CDs due in January into two CDs if possible.
3. Resolution to combine BOR boards- Assessor Mark Holley reviewed the reasons for consolidating
the three municipals BOR. He informed the board the City of Ovid passed the resolution at last
night’s meeting. The resolution will be only for this 2022 year. Mark Darling will be Middlebury
Township representative.

Resolution 01-2022
Interlocal Agreement for the City of Ovid, Ovid Township and Middlebury Township to
approve a Combined Board of Review for the period January 1, 2022 through December 31,
2022
Public Act 660 of 2018 allow the governing bodies of 2 or more contiguous cities or township to
agreement, appoint a single Board of Review to serve as the Board of Review for each of those
cities or townships for purposes of this act. The provisions in subsections (1) to (5) should serve
as a guide in determining the size composition, and manner of appointment of a Board of Review
appointed under this subsection. (MCL 211.28 (6))
Recitals
Whereas, The Township of Ovid and the City of Ovid are located within the County of Clinton,
and The Township of Middlebury is located within the County of Shiawassee, all in the State of
Michigan. Each of these units is contiguous to the others.
Whereas, P.A. 660 of 2018 allows each Township (Unit) to enter into an agreement that
combine their Board of Review and act as a single Board of Review.
Whereas, P.A. 660 of 2018 requires each Township (Unit) must be contiguous.
Duties and Responsibilities of Middlebury Township, Ovid Township and the City of Ovid
Combined Board of Review
1.) All Meetings of the Board of Review will be held at the Ovid Township Hall 1015 Baese Court,
Ovid, MI 48866
2.) Each Unit will appoint 1 member and 1 alternate to the Board of Review for a two year term.
The members will act in the following manor:
The alternate will be decided at the organization meeting, the Tuesday following the first
Monday in March
3.) Each Unit will be responsible for paying and training their members.
4.) Public Notice costs will be paid by each Unit for their Unit.
The resolution was offered by Clerk Tomasek Swan and supported by Trustee Atwood.

4. Checksforless purchase Clerk Swan made a motion for approval of check purchase in the amount
of $187.94 on order. Atwood Seconded the motion.

Michael Herendeen, OMESA, representative, recommended to the board a 2 mil for emergency service and
to run it for this year and run it as even years. Lynn Bowne, township attorney can write the language.
Treasurer Stevens brought up about an article in the paper about appropriating money for the firefighters,
ambulance crews or other front-line workers that worked during the COVID pandemic. Herendeen stated
concerns regarding offering money that way. Supervisor Swan also expressed concerns regarding doing
something like this to be fair to anyone and everyone. Stevens addressed the extra money in the emergency
fund and what we possibly should do with it. She discussed 2 mils verses 2.25 mils. Stevens asked about
the taxable value for OMESA’s payment, but the final number will not be ready until after BOR(Board of
Review) in March.
