M-21, Ovid, MI Tuesday, April 11, 2023 at 7:00 pm REGULAR MEETING Call to Order: Supervisor Swan called the meeting to order at 7:00 pm. Board Members Present: Trustee Greg Atwood, Trustee Gene Ruess, Treasurer Jill Ruess, Clerk Susan Tomasek Swan and Supervisor Jeff Swan Guests Present: 15 guests were present. Some of the guests were Gary Kiger; Shawn Dilts, Deputy Clerk; Dr. Holley, assessor Scheduled Comments: 1. County Commissioner: Not present 2. SATA Representative: Mary Rice from SATA identified that they have received some inquiries from Middlebury Township residents. SATA has been in operation since February 2000. It is a reservation basis service, not a fixed route service. Their budget is from 55% state and federal grants, 23% from fares of individuals & contracting agencies, 19% local municipal support (taxes and/or general fund), and 3% miscellaneous (advertising, interest, used vehicle sales, memorials, donations, etc.). Since COVID there was a decrease in ridership and there has been a rebound moving towards returning to pre-pandemic level. Being a participating municipality does not provide a guarantee of availability of ride. It does provide increased chances that the ride availability will occur. Motion to Approve Minutes: Clerk Tomasek Swan made a motion to approve as presented the March 14, 2023 minutes. Trustee Atwood seconded the motion. Voice Vote: Ayes: All Nays: None Carried Motion to approve Bills Clerk Tomasek Swan made a motion to approve bills from General Funds in the amount of $9,955.20 with checks #5920-5938 2 EFTs to include payment of Daystarr. Treasurer Ruess seconded the motion. Supervisor Swan attending. Local meeting this month discussed the Hazardous Materials collection in Durand. Library- Meeting minutes included in the packet. Still exploring software options. OMESA- Supervisor reports that one of the vehicles is needing repair/refurbishment. Obtaining a new engine is taking approximately 2 years for delivery. Clerk- Bid for stone clean up by Family Tree and Lawn Service. Trustee Ruess made a motion to accept the bid and seconded by Clerk Tomasek Swan. They are balanced with the county and minutes were provided to the Clerk. Business: 1. SATA- Discussion is only for Board Members. Trustee Atwood has made a motion to initiate the services from 5/1/2023 to 9/30/2023 in the amount of $2,107.85 for May 1, 2023 thru September 30, 2023 (at least) $5,058.82 (or slightly more) for October 1, 2023 thru September 30, 2024. Owosso Speedway Rezoning- Township has received a letter from Shiawassee County requesting a response from Middlebury Township regarding the variance. Treasurer Ruess made a motion for the Supervisor to attend the Shiawassee County Planning Commission meeting on 5/24/2023 at 7:00 pm to provide support in approval to rezone a parcel from A2 (agricultural/residential) to a B2 (General Business) parcel #005-14400-003, seconded by Trustee Atwood. Road Contracts Supervisor reports that the contracts have all come in lower than the original bids. The total cost of the contracts is $166,055. Clerk Tomasek Swan made a motion for the Supervisor to sign the agreements for the following the projects: Joint township scratch course/Chip seal Baldwin Rd-$60,400.00; Mineral Brine -$27,630.00; Chip Seal for Mason Rd- 3 | P a g e Middlebury Township 4/11/2023 minutes $35,000.00; Bituminous Paving for Prospect Ave, East First St., High St., Pearl Ave., Clinton St.- $22,400.00; Gravel Hauling for Mason Rd- $20,625.00 for a total amount of $166,055.00. Trustee Ruess seconded the motion. Approve Diane Alrich Aldrich for library representative Clerk Tomasek Swan made a motion to approve Diane Aldrich as the library representative at large. Treasurer Ruess seconded the motion. Passed on Voice vote 5. Treasurer Bonding Insurance Township attorney is drafting a legal opinion regarding the coverage cost of the bonding insurance by the county. 6. OMESA appropriation Trustee Ruess made a motion to appropriate $10,000 to OMESA and to issue a check to present at the next OMESA meeting. Treasurer Ruess seconded the motion. Driveway Update - Trustee Ruess updated the board on his latest contacts regarding the driveway. 8. Cemetery Fence revisit- Rita Gazda, township resident, has requested to have permission to remove and replace fencing behind her family plots. This request was denied due to liability. Cemetery sexton will be cleaning that fence line. 9. NSF Check Supervisor Swan will follow up with Township attorney regarding resolution and action.
